Terms of Use

1. Introduction & Acceptance

Welcome to Glamour, operated by Qubit Innovations ("we", "our", "us"). These Terms of Use ("Terms") govern your access to and use of the Glamour platform, which includes:

  • The Glamour mobile app (iOS & Android) for beauty service discovery and booking.
  • The Glamour Pro mobile app (iOS & Android) for beauty center management.
  • The Glamour web app at app.glamour.tn.

By creating an account, downloading the app, or using any part of our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These Terms apply to two types of users:

  • Clients — individuals who use Glamour to browse, compare, and book beauty appointments.
  • Professionals / Pros — beauty center owners, managers, and staff who use Glamour Pro to manage their business and receive bookings.

2. Eligibility & User Accounts

Eligibility:

  • You must be at least 18 years old to create an account on Glamour or Glamour Pro.
  • By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate, current, and complete.

Account responsibilities (all users):

  • Account access is via your phone number and a one-time passcode (OTP) received through WhatsApp or SMS. You are responsible for the security of your phone number and the confidentiality of the OTP codes you receive.
  • You must notify us immediately at support@glamour.tn if you suspect unauthorized access to your account.
  • You may not transfer or share your account with any third party.
  • Each individual or business may maintain only one account.

For Pros: When creating a Glamour Pro account, you represent that you have the authority to bind the beauty center or business you represent to these Terms. Pro accounts require a valid business address, contact number, and acceptance of the commission structure described herein.

3. User Conduct & Prohibited Activities

You agree to use Glamour responsibly and lawfully. The following activities are strictly prohibited:

For all users:

  • Providing false, misleading, or fraudulent information during registration or booking.
  • Impersonating any person, business, or entity.
  • Attempting to access accounts, systems, or data you are not authorized to access.
  • Using automated bots, scrapers, or scripts to access or extract data from the platform.
  • Engaging in any activity that disrupts or interferes with the platform's operation.
  • Using the platform for any unlawful purpose.

For Clients specifically:

  • Submitting fake, abusive, or defamatory reviews.
  • Repeatedly booking and not showing up (no-shows) without cancelling within the required timeframe.
  • Harassing or mistreating beauty center staff.

For Pros specifically:

  • Listing services you are not licensed or qualified to provide.
  • Using client contact information obtained via Glamour for unsolicited marketing outside the platform.
  • Manipulating reviews or ratings (soliciting fake reviews, penalizing clients for negative reviews, etc.).
  • Setting misleading prices or service descriptions.

Violation of these rules may result in immediate account suspension or termination.

4. User Content & Licenses

Content you submit: You may submit content to Glamour, including reviews (Clients), salon photos and descriptions (Pros), and profile information.

Your ownership: You retain ownership of any content you create and submit. However, by submitting content, you grant Qubit Innovations a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, and distribute your content in connection with operating and promoting the Glamour platform.

Content standards: All content you submit must:

  • Be accurate and not misleading.
  • Not infringe any third party's intellectual property, privacy, or other rights.
  • Not contain offensive, hateful, defamatory, or illegal material.

Reviews (Clients): By leaving a review, your first name and review content will be publicly visible. Do not include sensitive personal information in reviews.

Salon content (Pros): By uploading photos or descriptions, you confirm you have the right to use them and that they accurately represent your business.

We reserve the right to remove any content that violates these standards, without prior notice.

5. Intellectual Property

The Glamour platform, including its software, design, logos, brand name, trademarks, interfaces, and all proprietary content, is owned by Qubit Innovations and protected by applicable intellectual property laws.

You may not:

  • Copy, modify, distribute, sell, or lease any part of our software or services.
  • Reverse-engineer or attempt to extract the source code of our apps.
  • Use our brand name, logo, or trademarks without prior written consent.

For Pros: You grant us a license to display your salon's name, logo, photos, and service information on the Glamour Client app for the purpose of attracting bookings. This license terminates when your Pro account is deactivated.

6. Payments, Subscriptions & Billing

For Clients:

  • Downloading and using the Glamour app is free of charge.
  • There are currently no in-app purchases or paid subscriptions for Clients.
  • Payment for beauty services is made directly to the beauty center (in person) after your appointment, unless an online payment option is enabled by the salon.
  • Prices displayed are set by the Pro and are indicative. Final prices may vary depending on hair length, type, or specific service requirements. Always confirm pricing with the beauty center.

For Pros:

  • Access to Glamour Pro is subject to a revenue-share model: Qubit Innovations charges a commission of 10% of the service price (excluding VAT and applicable taxes) on each completed appointment booked through the Glamour marketplace.
  • The commission is calculated on the price displayed on the platform at the time of booking. No commission is due on cancelled or no-show bookings, unless otherwise stated in your onboarding agreement.
  • Qubit Innovations will issue a monthly commission invoice. Payment is due within 15 business days of the invoice date.
  • Non-payment may result in the suspension of your marketplace listing.
  • All fees are exclusive of applicable taxes unless otherwise stated.

7. Third-Party Services & Links

The Glamour platform integrates with third-party services in order to operate. These third parties have their own privacy policies and terms of use, and we are not responsible for their practices. Our main providers are:

  • Meta Platforms (WhatsApp for sending OTP codes; Instagram/Facebook for Pros' DM automation).
  • An AI processing provider (conversational assistant and AI automation).
  • A mapping and geolocation provider.
  • A push notification provider.
  • A cloud storage provider (hosting and file storage).

Salon services (for Clients): Beauty services are provided by independent beauty centers (Pros), not by Qubit Innovations. We act solely as an intermediary marketplace. We do not employ beauty professionals and are not responsible for the quality, safety, or outcome of any service provided.

8. Termination & Suspension

We may suspend or terminate your account if you:

  • Violate any provision of these Terms.
  • Engage in fraudulent, abusive, or harmful behavior.
  • Fail to pay outstanding commission invoices (Pros).
  • Repeatedly fail to honor appointments (Clients — no-shows).

You may close your account at any time by:

  • Going to Settings → Delete Account in the Glamour or Glamour Pro app, or
  • Emailing support@glamour.tn with the subject "Account Deletion Request".

For Pros: Termination of the Pro account requires 30 days' prior written notice (sent to support@glamour.tn), except in cases of material breach where immediate termination may apply.

Upon termination, your access to the platform will cease. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Liability, Indemnification, and Dispute Resolution) will remain in effect.

9. Disclaimers & "As Is" Warranty

The Glamour platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

  • The platform will be uninterrupted, error-free, or free of viruses or other harmful components.
  • The information on the platform (including salon descriptions, prices, and availability) is always accurate, complete, or current.
  • The results of using the platform will meet your expectations.

For Clients: We make no representations about the quality, suitability, safety, or legality of the beauty services provided by Pros. Any disputes regarding services must be resolved directly with the beauty center.

For Pros: We do not guarantee a minimum number of bookings or revenue through the Glamour marketplace.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Qubit Innovations shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the platform.
  • Any loss of revenue, data, goodwill, or business opportunities.
  • Any damage or injury resulting from a beauty service provided by a Pro.
  • Any unauthorized access to or alteration of your data.

In no event shall our total aggregate liability to you exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim (if any), or (b) 100 TND.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Qubit Innovations and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Glamour platform in violation of these Terms.
  • Any content you submit that infringes a third party's rights.
  • Your violation of any applicable law or regulation.
  • Any complaint or claim made by another user (including a Pro or Client) arising from your conduct.

For Pros: You additionally agree to indemnify Glamour for any claims arising from the beauty services you provide to Clients.

12. Dispute Resolution & Governing Law

Governing law: These Terms are governed by and construed in accordance with the laws of the Republic of Tunisia, without regard to conflict of law principles.

Informal resolution (first step): If you have a dispute with us, please contact us first at support@glamour.tn. We will attempt to resolve the matter informally within 30 days.

Formal disputes: If informal resolution fails, disputes shall be submitted to the competent courts of Tunis, Tunisia.

For users outside Tunisia: If mandatory consumer protection laws in your jurisdiction provide additional rights, those rights are not waived by these Terms.

13. Changes to the Terms

We reserve the right to modify these Terms at any time. When we make significant changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Send you an in-app notification or email at least 7 days before changes take effect (for material changes).

Your continued use of the platform after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using Glamour and delete your account.

14. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Qubit Innovations regarding your use of Glamour.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • No waiver: Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
  • Language: The controlling language of these Terms is French. The English version is provided for convenience only. In the event of any conflict, the French version shall prevail.

15. Artificial Intelligence Features

Glamour offers AI-assisted features (powered by an AI processing provider), including a conversational assistant and reply automation.

  • "As is" service: AI-generated responses are provided for guidance only and may be inaccurate, incomplete, or unsuitable. They do not constitute professional, medical, cosmetic, or legal advice.
  • Verification: You must verify any important information (prices, availability, nature of treatments) directly with the relevant beauty center. Qubit Innovations disclaims liability for decisions made solely on AI-generated content.
  • Acceptable use: You must not use the AI features to generate unlawful, misleading, abusive, or rights-infringing content.
  • Human assistance: Human assistance remains available at any time via support@glamour.tn.

16. Instagram & WhatsApp Message Automation (Pros)

Glamour Pro offers an optional feature to automatically manage Instagram direct messages (DMs) and WhatsApp Business conversations on your behalf.

  • Authorization and access: By enabling this feature, you connect your Instagram Professional account / Facebook Page and/or your WhatsApp Business account via Meta's OAuth protocol and grant Glamour an access token. You warrant that you have the necessary rights over these accounts.
  • Meta compliance: You agree to comply with Meta's Platform Terms, policies, and the WhatsApp Business API policy. Glamour uses access tokens only for the messaging actions you have authorized and may suspend the feature in case of non-compliance.
  • Pro's responsibility: You remain solely responsible for content sent on your behalf (including AI-generated replies) and for obtaining any required consent from your clients and followers.
  • Revocation: You may revoke access at any time from your Meta account settings or by contacting us. Revocation disables the automation.
  • Availability: This feature depends on Meta's APIs (Instagram and WhatsApp Business) and may be modified, limited, or discontinued if Meta changes its technical or contractual terms.
